FutureVault Generative Artificial Intelligence Terms

These Generative Artificial Intelligence Terms (“AI Terms”) are incorporated by reference into the FutureVault Terms of Service. The AI Terms and Terms of Service are collectively referred to as “Terms”. Capitalized terms not defined here have the same meaning as defined in the Terms. These Terms govern your use of generative AI features in our Services.

1. Generating Content. When you use generative AI features from input or uploaded content, such as but not limited to documents, scanned images, or text (collectively, “Input”). The Input will be used by the platform to generate an output, such as but not limited to text or documents which will be provided within the Services (collectively, “Output”). The Input and Output are your Content and all provisions governing Content in the Terms apply to the Input and Output. The generative AI features, Input, and Output must be used in accordance with the Terms, which may be modified from time to time. FutureVault reserves the right to throttle, limit, disable, suspend, or terminate your right to use or access the generative AI features at any time in our sole discretion without prior notice to you.

2. Input. You are solely responsible for your Input. You must not submit any Input that:

(a) includes trademarks or other materials protected by third-party Intellectual Property Rights, unless you have sufficient rights in such materials;

(b) is intended to generate Output that is substantially similar to a third party’s copyrighted work or is otherwise protected by third-party Intellectual Property Rights, unless you have sufficient rights in such work;

(c) contains personal information unless you comply with all data protection and privacy laws and regulations applicable to the personal information, including providing privacy notices and obtaining consent, where required;

(d) violates applicable law; or

(e) violates the Terms.

We may automatically block your Input, in our sole discretion, if we believe it violates the rights of a third party, applicable law, or the Terms.

3. Output.

(a) Your Responsibility. You are solely responsible for the creation and use of the Output and for ensuring the Output complies with the Terms; however, we may use available technologies, vendors, or processes to screen for and block Output that may violate applicable law, the rights of a third party, or the Terms, before the Output may be delivered to you. FutureVault disclaims all warranties, express or implied, regarding the Output, including any implied warranties that the Output will not violate the rights of a third party or any applicable law.

(b) Suitability of Output. Use of generative AI features may produce Output that is misleading, inaccurate, unexpected, or unsuitable. The Output may not be unique and other users of generative AI features may generate the same or similar Output. The Output may not be protectable by Intellectual Property Rights.

(c) No AI/ML Training. You must not, and must not allow third parties to, use any content, data, output or other information received or derived from any generative AI features, including any Outputs, to directly or indirectly create, train, test, or otherwise improve any machine learning algorithms or artificial intelligence systems, including any architectures, models, or weights.

(d) Financial, Mathematical, and Fiduciary Limitations of Output. The generative AI features are intended to assist with the retrieval, summarization, and interpretation of information contained in Content. While such Content may include numerical, financial, or quantitative data, the generative AI features are not designed, intended, or approved to perform calculations, financial modeling, portfolio analysis, performance measurement, forecasting, valuation, asset allocation, reconciliation, or other quantitative or analytical functions that require precision, completeness, or professional judgment.

The Output does not constitute investment advice, financial advice, accounting advice, tax advice, or a recommendation or opinion regarding the suitability of any investment, strategy, or course of action for any person or account. The Output is not intended to be used, and must not be relied upon, in connection with fiduciary duties, suitability determinations, best interest obligations, regulatory reporting, or client disclosures under applicable securities, investment, or financial services laws or regulations.

Any numerical or financial information included in the Output is provided for informational and contextual purposes only, may be incomplete, approximate, or inaccurate, and must be independently verified using appropriate portfolio management systems, financial planning tools, accounting software, or other purpose built analytical tools prior to use.

You acknowledge and agree that you retain sole responsibility for all calculations, analyses, interpretations, decisions, and actions taken in reliance on or in connection with the Output. FutureVault expressly disclaims any representation or warranty that the Output satisfies regulatory requirements or professional standards applicable to registered dealers, advisers, fiduciaries, or other regulated financial professionals.
